SERVICE PROCUREMENT OF “PRIVATE SECURITY FOR THE SCHOOLS AND TECs IN WHICH SYRIAN CHILDREN ARE PROVIDED WITH EDUCATION UNDER THE PROJECT ON PROMOTING INTEGRATION OF SYRIAN CHILDREN INTO TURKISH EDUCATION SYSTEM”

to be conducted through bargaining procedure in accordance with the Article 21 (b) of the Public Procurement Law No. 4734. Further details are available as follows:

3.2. Bidders may either submit their bidding documents to the above-mentioned address directly or send with an enclosed file to the same address via certified mail-return receipt no later than the tender date. Bidding documents, which are failed to be delivered to the Administration in time (until deadline), shall in no case be taken into consideration.

3.3. Submitted bids, are in no case allowed to be re-taken except for adding an addendum. 

3.4. In case tender date coincides with a vacation date, the tender shall be organized in the first day following the vacation date at the above-mentioned location and hour. Bidding documents submitted in the mentioned time shall only be accepted.

3.5. Even if there is an amendment to the work-hour after the announcement, the tender shall be organized in the above-mentioned hour. 

3.6. The national hour of Turkish Radio Television Organization (TRT) is based for hour adjustments.

Article 4 – Availability and purchase of tender document and the obligation of EKAP registration

II- PROVISIONS TO SUMMIT BIDS FOR THE TENDER

Article 5 - Compliance with Terms and Conditions and Required Documentation: 

5.1. Documents related to economic and financial capacity and the criteria to be met with those documents

5.1.1. The bidders shall submit end-year balance-sheet or equivalent documents belonging to the year before the tendering year as follows:

  1. Bidders, obliged to make their balance-sheet be published in accordance with the related legislation shall submit year-end balance-sheet or the related parts, proving that the required criteria of the balance-sheet is met;
  2. Bidders, who are not obliged to make the balance-sheet be published in accordance with the related legislation, shall submit the end-year balance sheet or the parts of the balance sheet proving that the required criteria is met or submit the document proving that the above criteria is fulfilled and certified by a Freelance Accountant, Certified Financial Accountant or Freelance Accountant Financial Consultant in accordance with the Standard Form (Standard Form: KİK025.1/H)

For the balance-sheet or equivalent documents;

  1. Current ratio (current assets/short-term debts) indicating whether it has the liquidity necessary to enable it to provide cash flow in certain periods and has the power to pay the debt within short-term (one year) the current ratio is to be at least 0,75 (while calculating, long-term construction costs shall be deducted from current assets and long-term construction revenue prices shall be deducted from short-term debts.)
  2. The equity ratio (equity / total assets) indicating how much of active assets are comprised of equities are to be at least 0,15 (while calculating, long term calculation costs shall be deducted from total assets.)
  1. The ratio of short-term bank debt to equity shall be less than 0.50, and these three criteria shall be fulfilled together. Long-term construction costs as well as long-term construction revenue prices- if available-shall be submitted with the balance sheet.

Bidders, who failed to fulfill the eligibility criteria in the previous year, are allowed to submit documents for the last two years. In that case, whether the eligibility criteria are fulfilled considering the average of the financial amounts in the last two years shall be checked.

It is obligatory that the balance-sheet and the parts of the balance-sheet indicating that the above mentioned eligibility criteria are fulfilled shall be in compliance with the relevant legislation and these documents shall be verified by a freelance accountant, a certified financial advisor or a freelance accountant and financial advisor or a tax office. When issued in a foreign country, the balance-sheet or part(s) of the balance-sheet, indicating that the above-mentioned eligibility criteria are fulfilled; shall be confirmed/certified by an authorized body, which has permission to prepare and issue these documents in accordance with the national legislation of the relevant country. In case balance-sheets or part(s) of the balance-sheets, having no publishing requirement, issued in a foreign country are not submitted; then these documents may be submitted with a document confirmed/certified by an authorized body in accordance with the relevant national law of that country.

According to the values indicated and approved with an income-summary sheet submitted by a freelancer, the ratio of the total income in the last year to the total expenditures or the ratio of the financial amounts of income and expenditures in the last two years shall be at least (1,25). The summary of the income statement shall be confirmed by a freelance accountant, a certified financial consultant or a freelance accountant and financial consultant or tax office.

Provided that bidder is a partnership, each shareholder is to submit required documents separately and shall fulfill the required criteria.

5.1.2.   Bidder shall provide at least one of the followings:

a) Income statement (chart) designating the total revenue belonging to the year before the tender year;

b) Invoices, indicating the financial value of the service-works continuing under guarantee and the completed services, issued in the year before the tender year.

Total revenue derived from the performed works in both national and international area, shall be taken into consideration in the account for continuing works under guarantee and the completed works.

Total turnover shall not be less than the 20% of the submitted inquiry. The value of the performed part(s) of continuing work under guarantee or value of the completed work shall not be less than 12% of the submitted inquiry. Bidders, who provide with any of these criteria and submit the documents through fulfilling those criteria are considered as eligible.

Bidders, who failed to fulfill the eligibility criteria in the previous year, are allowed to submit documents for the last two years. In that case, whether the eligibility criteria are fulfilled considering the average of the monetary amounts in the last two years shall be checked. Income-statement shall be certified/confirmed by a freelance accountant, a certified financial accountant or a freelance accountant financial consultant or a tax office. Income-statement issued in a foreign country shall be in compliance with the legislation of that country and shall be confirmed by an authorized body permitted to certify this document.

For the bidders, who participated in the tender as a partnership, criteria related to the work volume shall be provided based on each partners’ share. Considering the work-volume value of the bidder, total work volume value is determined through adding work-volume value to the partner imitative(s) work-volume value based on the share rates. In that case, the work-volume value of the bidder with the documents indicating their share-rates within the partnership shall be submitted. For the bidders, who participate in the tender as a consortium, each of the companies shall fulfil their own criteria related to the work-volume.

5.2. Documents related to vocational and technical competencies and the criteria to be met with those documents.

5.2.1. Related to the technological product experience certificate or the work subjecting to this tender committed in the scope of a single contract including value with national or international public or private sector, following documents shall be submitted:

a) Documents certifying the work experiences related to service procurements of which the approval processes had been completed in 5 years’ time starting from the first announcement date; or

b) For the transferred works, documents proving the service work experiences of which the approval processes had been completed in 5 years’ time starting from the first announcement or invitation date provided that at least 80% of the first contracted value is realized in the pre-closing transfer or post-closing transfer period. Provided that the offered value is not less than 25%, documents proving the work experiences subjecting to tender and related to similar work experiences as well as technological product experience certificates.

In partnerships, pilot partners shall meet the minimum 70% of requested work experience amount; each of the other shareholders shall meet the minimum 10% of requested work experience amount or the total amount of work experiences of the shareholder(s) shall not be less than 30% of the requested work experience costs 

Provided that the partnership share ratio and the structure are same, in case the documents proving the work experience obtained from a work of a partnership, which has previously been implemented; the minimum work experience that shareholders shall meet in accordance with the ratio as laid out by the provision of the first sentence of this paragraph is not binding. As for the consortiums, it is obligatory to provide work experience amount requested for the shares of each shareholders. 

In case the bidder submit technological product experience certificate, it is deemed that; the bidder carries the eligibility criteria related to the work experience. In partnerships, the shareholder, which submits the technological product certificate, minimum eligibility criteria related to the work experience amount is deemed to be provided. In case the consortium shareholder submits the technological product experience certificate, the eligibility criteria is deemed to be provided for the part or parts of the submitted documents.

5.3. Works deemed to be a similar work in this tender:

5.3.1. Experiences in Private Security Services in public and private sector are deemed to be similar work experience. 

Article 6 – Openness to foreign bidders:

6.1. The tender is open to all national and international bidders carrying the eligibility criteria.

Article 7 – Bid Bond

7.1. Bidders shall provide a bind bond including the price that they will determine by their own but it shall not be less than 3% of the offered price. Submitted offers less than the amount of 3% remains out of evaluation.

7.2. In case the bidder is a type of partnership initiative (joint-venture), total bid bond amount may be covered regardless of the share ratio or the bid amount valued for the parts that shall mention experience by one or few of the shareholders. 

7.3. Bid validity date shall be mentioned in bid bonds submitted as temporary guarantee. This date is determined by the bidder providing that it shall not before the date of 12.12.2018

7.4. Inquiries without an acceptable bid bond may be considered as out of evaluation by the Administration for the reason that required tender eligibility is failed to be fulfilled.
